These Terms of Service govern your use of the Secoh Australia website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms.
About Us
This website is operated by Secoh Australia (“we”, “us”, “our”).
By using our website and services, you agree to comply with these Terms of Service.
Use Of Website
You agree to use our website for lawful purposes only and not to engage in any conduct that may damage, disrupt or interfere with the operation of the website.
We reserve the right to restrict or terminate access to the website at our discretion.
Products And Orders
All products are subject to availability. We reserve the right to:
-
Limit quantities.
-
Discontinue products without notice.
-
Refuse or cancel orders where there is a pricing error, stock unavailability, suspected fraud, incorrect product information, or other legitimate reasons.
Product descriptions and pricing are provided in good faith. Minor variations may occur.
An order is not accepted until payment has been processed and you receive an order confirmation. We reserve the right to cancel any order prior to dispatch.
Pricing And Payment
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
Payment must be made in full at the time of purchase. We accept payment methods made available through our website. Payment processing is handled securely by third party providers.
Shipping And Delivery
Delivery Estimates: Delivery times provided at checkout or in communications are estimates only. While we prioritise prompt dispatch, we do not guarantee specific delivery dates. Secoh Australia is not liable for any loss, damage, or stress caused by delays within third-party courier networks, which are entirely outside of our control.
Carrier Responsibility: Once goods have been collected by the courier from our facility, the responsibility for transit and delivery rests with the transport provider. We provide tracking information for all orders; customers are responsible for monitoring their shipment and contacting the courier directly for delivery updates or redirect requests.
Risk and Title: Risk in the goods passes to you once the carrier confirms delivery to the address provided in your order. We are not responsible for theft or damage occurring after the point of delivery.
Inspection Period: Please inspect your order immediately upon arrival. Any claims for transit damage or incorrect items must be submitted in writing with supporting photos to Secoh Australia within 48 hours of receipt. Claims made after this period may not be accepted by the carrier.
Force Majeure
Secoh Australia is not liable for any delay or failure to perform obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to natural disasters, supplier delays, transport disruptions, power outages or acts of government.
Refunds And Returns
We do not accept returns or provide refunds for change of mind.
Where a product is faulty or does not meet consumer guarantees under Australian Consumer Law, remedies will be provided in accordance with our Refunds & Returns Policy and applicable law.
Nothing in these Terms limits or excludes your rights under Australian Consumer Law.
Warranty & Product Remedies
Products are covered by manufacturer warranties as outlined on the specific product pages of this website. All warranty claims are assessed prior to approval and are strictly subject to:
-
Correct Installation: Including, but not limited to, the mandatory use of supplied pressure relief valves where specified (e.g., TKO-200 models).
-
Intended Use: The product must be used for its designed application and maintained according to manufacturer standards.
-
Specific Remedies: For certain professional-grade models, such as the Secoh JDK-80 and TKO-200, the warranty is fulfilled via the provision of a Replacement Chamber Block Kit to restore the unit to full operation. Except in cases of verified motor seizure (TKO-200) or major failure as defined by Australian Consumer Law, we do not offer full unit replacements or refunds for warranty-related claims.
All sales are final, and we do not provide insurance or cash refunds for warranty-supported items.
Limitation Of Liability
To the extent permitted by law, Secoh Australia is not liable for:
-
Indirect or consequential loss.
-
Loss of profits, revenue or business.
-
Damage arising from misuse or incorrect installation.
Nothing in these Terms excludes consumer guarantees that cannot be excluded under Australian Consumer Law.
Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.
